1. Agreement to Terms
By accessing or using Predictaero's aviation maintenance management platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service, including organizations and their authorized personnel.
2. Description of Service
Predictaero provides a cloud-based Technical Logbook (TLB) management system for aviation operators, including but not limited to:
- Digital technical logbook management
- Defect reporting and tracking
- Deferred Defect Log (DDL) management with MEL/CDL support
- Certificate of Release to Service (CRS) issuance
- Fleet and personnel management
- Compliance reporting and analytics
3. User Accounts
3.1 Account Creation
To use the Service, you must create an account with accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.2 Organization Accounts
Organizations subscribing to Predictaero are responsible for managing user access, assigning appropriate roles, and ensuring their personnel comply with these Terms. Organization administrators have the authority to grant and revoke access.
3.3 Account Security
You must immediately notify Predictaero of any unauthorized use of your account or any other breach of security. Predictaero will not be liable for any loss or damage arising from your failure to protect your account credentials.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of aviation regulations
- Enter false, misleading, or fraudulent maintenance records
- Share account credentials with unauthorized individuals
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or servers
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to transmit malware or harmful code
- Scrape, data mine, or extract data from the Service without authorization
5. Aviation Compliance
5.1 Regulatory Responsibility
While Predictaero is designed to support compliance with aviation regulations (EASA, FAA, CAA), the ultimate responsibility for regulatory compliance rests with the aircraft operator. Users must ensure that their use of the Service complies with all applicable aviation regulations in their jurisdiction.
5.2 Record Accuracy
Users are solely responsible for the accuracy and completeness of all data entered into the Service. Predictaero does not verify the accuracy of maintenance records, defect reports, or other aviation documentation entered by users.
5.3 Digital Signatures
By using digital signature features within the Service, you acknowledge that your electronic signature has the same legal effect as a handwritten signature and that you are authorized to sign on behalf of your organization where applicable.
6. Subscription and Payment
6.1 Subscription Plans
Access to the Service requires a paid subscription. Subscription plans, pricing, and features are as described on our website or in your service agreement.
6.2 Payment Terms
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as expressly stated in these Terms or required by law.
6.3 Cancellation
You may cancel your subscription at any time. Upon cancellation, you will retain access to the Service until the end of your current billing period. Data export options are available before account termination.
7. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Predictaero and is protected by international copyright, trademark, and other intellectual property laws. You retain ownership of all data you enter into the Service.
You grant Predictaero a limited license to use, store, and process your data solely for the purpose of providing and improving the Service.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described in the Privacy Policy.
9. Service Availability
9.1 Uptime
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance when possible.
9.2 Modifications
Predictaero reserves the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes that may affect your use of the Service.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PREDICTAERO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.
PREDICTAERO'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO PREDICTAERO IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
PREDICTAERO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
12. Indemnification
You agree to indemnify and hold harmless Predictaero and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Predictaero is incorporated, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of that jurisdiction.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
